The Aboriginal Flag: Harold Thomas is the copyright owner of this flag, and permission must be obtained from him for all commercial uses. Shots where the flag is the main focus or subject matter are unsuitable for commercial use and should be made available for editorial use only.

Recently the copyright for the flag was purchased by the Australian government, but Harold  Thomas still maintains the moral rights for this flag.   It is stated that anyone in Australia can use the flag as long it’s used  in a positive light.  It does not state if this holds true for anyone outside of Australia.  There are still royalties attached which are being donated to the  National Aborigines and Islanders Day Observance Committee (NAIDOC). Due to these intricacies surrounding the flag, content is still not suitable for Creative use, only Editorial.  

 

Three other Australian flags that are problematic include the following:

 

Torres Strait Islander Flag: Permission for commercial use is required from the Torres Strait Island Regional Council. Shots where the flag is the main focus or subject matter are unsuitable for commercial use and should be made available for editorial use only.

 

Boxing Kangaroo Flag: The copyright in this flag is owned by the Australian Olympic Committee (AOC). Therefore, images featuring this flag cannot be used for commercial use without permission of the AOC. Shots where the flag is the main focus or subject matter are unsuitable for commercial use and should be made available for editorial use only.

 

Australian White Ensign: This emblem is protected under the defense act and can not be used with out permission by the Department of Defense.
